A student may need an online education portal to enrol or receive financial assistance. A patient may be asked to share sensitive health information through a digital record or application. A taxpayer may have to submit personal details through an online system. These are not merely technical transactions. They are moments in people’s lives when access to education, healthcare, public services and economic opportunity can depend on whether a digital system functions and is trusted by its users.

Pakistan’s vision of becoming a “Digital Nation” reflects an aspiration to use technology to make public life more connected, efficient and accessible. Realising this vision, however, will require more than the development of new platforms and databases. It will depend on whether people feel informed, respected and confident when they use digital tools. Every digital service requires individuals to share their personally identifiable information, such as their name, phone number, photograph, fingerprint or location. Digital systems are therefore most effective when people understand what information is being collected about them, who can access it, how long it will be kept and what remedies are available if the system makes an error, experiences a data leak, or is affected by human error.

For a woman facing online abuse, the ability to report harm safely may matter more than the sophistication of the platform. For a patient, uncertainty about who can see their medical information may discourage them from seeking care. These experiences illustrate why privacy is not an abstract legal concern. It shapes whether people can use digital services freely and with dignity.

For this reason, privacy should remain a central consideration in Pakistan’s digital transformation. A country cannot become meaningfully digital by connecting databases alone. It becomes digital when people can participate in that transformation without compromising their privacy.

Digital Governance, Privacy and Freedom of Expression

Pakistan’s digital evolution is taking place in a difficult environment. Online expression is already constrained, and international assessments have repeatedly described the country’s internet as heavily restricted. Freedom House has classified Pakistan as “Not Free” in its Freedom on the Net reporting, while Reporters Without Borders ranked Pakistan 153rd out of 180 countries in its 2026 World Press Freedom Index.

These assessments matter to privacy because people are less likely to speak, search, organise or report information when they fear that their identity, communications or online activity may be exposed or misused. In a restricted information environment, privacy provides a measure of personal space in which individuals can form views, seek information and communicate without unnecessary monitoring. The relationship also works in the other direction: when privacy is weak, restrictions on expression can become more powerful because the risk of being identified may deter people from participating before any censorship even takes place. Privacy and freedom of expression should therefore be treated as interconnected rights; not because they are identical, but because the protection of one can determine whether people are able to exercise the other.

The Digital Nation Pakistan Act, 2025, is part of this wider transformation. It aims to organise and centralise the country’s digital governance, including digital services, data systems and cybersecurity. The scale of that ambition makes the law significant. It also makes the safeguards around it impossible to treat as an afterthought.

The Digital Rights Foundation (DRF)’s policy brief, The Cost of Going Digital: Evaluating Rights Risks in Pakistan’s Digital Governance, identifies a central concern: although the country is rapidly expanding the collection, integration, and use of data, it still does not have enacted personal data protection legislation. Pakistan’s Personal Data Protection Bill has undergone several iterations and extensive consultations over the years, yet it remains a bill rather than an Act, repeatedly positioned as being close to legislation without ultimately becoming a law. Against this backdrop, DRF has submitted detailed analysis and recommendations on the National Artificial Intelligence Policy 2025, the Draft National Data Governance Policy, and the Personal Data Protection Bill itself, bringing questions of privacy, accountability, inclusion, and human rights into policy discussions.

This legislative uncertainty is significant because the issue is not simply the existence of digital systems, but the protections that govern them. A rights-respecting system must clearly establish what data may be collected, for what purposes, who may access it, how long it may be retained, and what remedies are available when an error or misuse occurs. It must also identify the institutions responsible for oversight and provide them with sufficient independence to investigate complaints. The objective should therefore be to create a digital environment in which rules are clear, institutions are transparent, and individuals can participate with greater confidence.

The Role of National Human Rights Institutions

This is where National Human Rights Institutions and other independent rights bodies become essential. The National Commission for Human Rights, the National Commission on the Status of Women, and the National Commission on the Rights of the Child each bring a different perspective to the digital governance debate.

Their contribution is particularly important because digital systems can affect different communities in distinct ways. Women may face gender-based online abuse. Children may require stronger safeguards. People living in remote or underserved areas may need alternatives when online access is limited. Listening to these perspectives early can improve policy before problems emerge, and it can also help institutions identify practical solutions, from accessible complaint mechanisms to stronger transparency requirements and more inclusive service design.

At a multi-stakeholder roundtable convened by DRF at the National Commission for Human Rights in Islamabad, Pakistan in December 2025, national commissions, civil society organisations and digital rights advocates discussed the implications of the Digital Nation Act. The discussion pointed towards a practical starting point: digital governance must be built around clear data protection standards, independent oversight, transparent data management and assessments that consider gender and inclusion. Discussions like this are critical because decisions about digital governance are frequently made without adequate input from civil society or affected communities. Once implemented, these decisions are difficult to reverse, making early, inclusive dialogue essential rather than optional.

Community Perspectives in Digital Rights Advocacy

Digital policy is strengthened when it is informed by the realities of people’s lives. A service that works well in a city may need to be adapted for a rural community. An online reporting process may need to account for language, literacy, disability or limited connectivity. A safety policy may need to reflect the experiences of women and other groups who face disproportionate online abuse.

Community engagement helps to bring these realities into the policy process. It turns abstract ideas such as “access”, “security” and “inclusion” into practical questions: Can people use the service? Do they understand it? Do they feel safe? Can they receive help when they need it?

DRF's Digital Security Helpline illustrates the value of this community-facing approach. When survivors call in distress, the helpline provides psychological support and a compassionate first point of contact. The Incident Response Analysts at the helpline listen to what has happened, help survivors feel heard and supported, and then guide them through the options available to them. This includes practical digital-security steps, reporting options, referral to relevant support services or other appropriate avenues for redress. Where a case requires further action, the helpline also supports the escalation of harmful content or complaints through the relevant channels, while taking the survivor’s safety, consent and circumstances into account.

This direct engagement does more than assist individuals in moments of crisis. It helps the helpline to identify recurring forms of digital violence, barriers survivors face when seeking solutions and the kinds of institutional responses that are needed. In that sense, the helpline connects immediate support with wider advocacy: it helps survivors navigate possible remedies while bringing patterns and community experiences to the attention of stakeholders who can press for stronger responses.

The helpline shows that digital safety is not only about technology. It is also about empathy, timely support and the ability to seek meaningful redress. When affected communities are included from the beginning, they do more than identify risks. They also contribute ideas, local knowledge and solutions. Their participation can help Pakistan build digital systems that are more useful, accessible and trusted.

Towards a Rights-Respecting Digital Nation

Pakistan does not have to choose between digital development and human rights. In fact, the two depend on each other. The success of Pakistan’s digital transformation will not be measured only by how many services move online or how quickly new systems are introduced. It will also be measured by whether people feel able to participate in that future. The measure of progress will be visible in ordinary experiences: whether a student can access an education service without unnecessary exposure of personal information; whether a patient can use a digital health service without losing confidence in the privacy of their records; whether a taxpayer can complete an online process and understand how their information will be used; and whether a person facing digital abuse can seek help without being placed at further risk. These are the points at which national policy becomes personal.

Can people understand how their data is used? Can they access support when they face digital harm? Can women, children, and marginalised communities expect meaningful protection? Can journalists and citizens contribute to public conversations without fear or uncertainty? These questions point towards practical steps that Pakistan can take as it develops its digital governance framework. A digital nation can combine innovation with respect for human rights, improve efficiency while preserving dignity, and use technology to expand access to opportunity. Achieving this will require systems that are designed through meaningful consultation and are responsive to the needs of all communities. The task is not simply to digitise the relationship between people and the state. It is to build a relationship in which people remain visible as rights-holders rather than becoming invisible as data points.

About Digital Rights Foundation

This article was written by Digital Rights Foundation (DRF), a female-led, not-for-profit, non-governmental organisation working on providing safe online spaces in Pakistan since 2013.

Learn more

ID Systems

Economic, social and cultural rights

Health Data

Location

Pakistan

More about our partner

Digital Rights Foundation

Change

We are building a global movement

Content

Stories

Media

DRF 2.png

Summary

Pakistan’s vision of becoming a “Digital Nation” reflects an aspiration to digitise public life. We agree that advertiser verification processes and ad repositories are key safeguards against online manipulation and misinformation. However, we are saddened to observe that these benefits have not been equally distributed among your global user base.
Each platform operates fluctuating and often widely differing transparency standards for different countries. While some users benefit from seeing political advertising in an ad repository, others do not. Where some users are offered detailed information about a political ad, others are not. There are no legitimate or otherwise publicly disclosed reasons justifying this difference in treatment.
The combined effect of these inconsistent policies is to create a two-tiered user base within each platform, with a wide regulatory gap separating the transparency haves and have-nots. We first highlighted these problems in 2019. While some progress has been made since, we are disappointed to conclude that the transparency divide persists.
Online transparency should not be a privilege of the few, but the right of all. To that end, the changes we believe are necessary are as follows:

Accelerate the expansion of full transparency tools to all countries where you operate to ensure that the least favoured countries benefit from the same level of transparency as the most favoured countries

Develop, and make public, a plan of action setting out commitments and related timescales to roll out full transparency tools globally

Disclose the full array of criteria, both past and present, used to select countries qualifying for higher transparency standards

The above changes, which we believe to be fair and reasonable, are only a starting point to begin to correct the current platform-created inequality between users. By contrast, the benefits are conclusive: heightened transparency standards for millions of users worldwide, and increased legitimacy of online political advertising for the sake of fair and informed decision-making by voters.
We urge you to take responsibility as two of the most influential platforms in online political campaigning, and empower users and voters with heightened ads transparency.

Yours sincerely,

Access Now
Africa Freedom of Information Centre (AFIC)
Aliansi Jurnalis Independen/Alliance of Independent Journalists (AJI)
Amnesty International
ApTI
Article 19
Association for International Affairs (AMO) in Prague
Association pour le Developpement Integré et la Solidarité Interactive (ADISI-C)
Citizen D
Centre for Independent Journalism Malaysia (CIJ-M)
Collaboration on International ICT Policy for East and Southern Africa (CIPESA)
Civil Liberties Union for Europe
Bytes for All (B4A)
Datos Protegidos
Defend Democracy
Dejusticia
Democracy Reporting International (DRI)
Derechos Digitales
Digital Rights Foundation
ELSAM
Electronic Frontier Finland
Electronic Frontier Norway
epicenter.works
EU Disinfo Lab
Fundación Acceso
Fundación Huaira de Quito-Ecuador
Fundación Internet Bolivia
Fundación Karisma
Freedom Forum
Free Media Movement (FMM)
Global Forum for Media Development
Global Witness
Hiperderecho
Homo Digitalis
Instituto Brasileiro de Defesa do Consumidor
InternetLab
Intervozes - Coletivo Brasil de Comunicação Social
IPANDETEC Centroamérica
Irish Council for Civil Liberties (ICCL)
Laboratorio de Datos y Sociedad (DATYSOC)
Media Foundation for West Africa (MFWA)
Media Institute of Southern Africa MISA- Zimbabwe
Media Matters for Democracy
Merit Legal Advocacy & Human Rights Initiative (MELAHRI)
OBSERVACOM
Paradigm Initiative (PIN)
Privacy International
R3D: Red en Defensa de los Derechos Digitales
SFLC.in
Stiftung Neue Verantwortung (SNV)
Sursiendo, Comunicación y Cultura Digital AC
TEDIC
The Tor Project
Unwanted Witness
Usuarios Digitales
Venezuela Inteligente
Who Targets Me
World Wide Web Foundation
Xnet

Repeating Image and Text

More about our partner

La Asociación por los Derechos Civiles

The Association for Civil Rights (ADC) is a non-governmental organisation based in Buenos Aires that promotes civil and social rights in Argentina and other Latin American countries. This means permissions can be defined by the app - including access to the microphone, camera and location - without triggering the standard Android security prompts. Users are therefore completely in the dark about these serious intrusions.

We are concerned that this leaves users vulnerable to the exploitative business practices of cheap smartphone manufacturers around the world.

The changes we believe are needed most urgently are as follows:

Individuals should be able to permanently uninstall the apps on their phones. Pichai,

Privacy violations are used to oppress women and gender diverse people. But those cases are not the only way in which privacy and gender-based violence are linked.

Gender-based online violence: No place to hide

Survivors of online gender-based violence talking about their experience tend to describe a degree of abuse that becomes impossible to escape. In a world where technology has become inseparable from the physical world and we rely on it in our everyday lives, the abuse ends up impacting every aspect of our lives. This inescapability is key to understanding how the experience of harassment and online gender-based violence is related to privacy.

The right to privacy was first addressed as such in a legal context with American lawyers Samuel Warren and Louis Brandeis defining it as “the right to be let alone.” Online gender-based is an attempt by an abuser to never let their target alone, to deny them a private space, be it online or offline, to the extent that such a distinction is even still feasible.

And with the further development and roll out of connected devices, the future of online-gender-based violence will carry new opportunities for abuse. Interviewed in Privacy International’s report on Gender and Privacy, Leonie Tanczer, lecturer at UCL’s Department of Science, Technology, Engineering and Public Policy, told us: “While now harassment can take place on platforms such as Twitter or through the interference with very distinct devices such as my tablet, in the very near future one will be able to tamper with my connected driverless car, my smart lock, or just troll me through my dozen Internet-connected devices.”

Online-gender-based violence cannot be divorced from the social context in which it happens. It is now an isolated phenomenon happening online but the reflection of patriarchal structures that allow men (in most cases) to feel entitled to harass women and gender-diverse people online.

Online harassment targeting women and LGBTIQ persons

SMEX – our partner in Lebanon – have looked at the specific context of online harassment against women and LGBTIQ individuals in Lebanon. Their report highlights the adversarial role of the authorities, which are preventing survivors – in particular LGBTIQ individual – from handling online blackmail and privacy threats in a safe and sustainable way. But most of all their interviewees believed that “that the most effective long-term solutions to online privacy threats involves changing the current societal and legal landscape and promoting an environment that is safe and inclusive both offline and online, for women and members of the LGBTIQ communities.”

Legal frameworks restricting the expression of sexuality

The Foundation for Media Alternatives (FMA) – our partner in the Philippines – noted a similar trend with a legal framework that remained gender-insensitive, sometimes “restricting full expression of one’s sexuality” despite a rise in the number of privacy violations online that target women and LGBTQIA+ individuals in the Philippines. In their report, FMA demands and change and condemns “centuries-old cultural assimilation of a patriarchal worldview, further skewed by restrictions imposed by organized religion [that] has made Filipino notions and standards of privacy inherently unfair to women and the LGBTQIA+ community.”

The need for a principle and comprehensive approach

In Chile, our partner Datos Protegidos also noted the need for a change in the legal framework in their nine recommendations (in Spanish) for a safer internet for women and the LGBTIQ+ community in Chile. In particular, they propose to change to the Chilean cybercrime law, adding new penalties for non-consensual image sharing and compensations proportional to the abuse that survivors have experienced.

Datos Protegidos also stresses the need for trainings of law enforcement to insure they are qualified to adequately handle online-gender based violence. This is an issue that Privacy International has observed across the world: civil society organisations working on the issue of online-gender-based violence all raised the issue of law enforcement’s lack of familiarity and/or capacity when it comes to responding to survivors’ complaints.

Ride sharing apps from a gender perspective

We highlighted earlier the new forms online-gender-based harassment will take, as we step into a world where the border between online and offline becomes blurry and the online/offline divide becomes irrelevant.

Our partner in Pakistan, the Digital Rights Foundation explore an aspect of this question in their report on ride-sharing apps. The report looks at the various forms of harassment consumers had experienced when using those apps and the complaint mechanisms in place. Based on surveys and interviews, the report found out complaint mechanism was the only recourse for women who feel unsafe on the apps.

The need for a gendered right to privacy

All of these cases show that with technologies transforming our experience of the world, we will need a right to privacy well suited to protect women and gender diverse people from new forms of abuses, which will keep emerging as long as the patriarchal structures that fuel gender-based violence remain unchallenged.

We want a right to privacy that will help deconstructing and smashing those structures and we are looking for your contribution to that fight, not just on women’s day, but for the years to come. It can be used to track attendees of a political demonstration or a public event like a football match. IMSI catchers represent an enormous invasion of our right to privacy, and potentially our rights to free expression and free assembly.

In 2018, we filed an appeal before the First-tier Tribunal in the UK to challenge a series of decisions by the Information Commissioner’s Office upholding the refusal of various police forces to disclose information about their purchase and use of IMSI catchers.

The case emerged from a series of Freedom of Information (FOI) requests submitted by PI to police forces across the UK to find out which ones among them had purchased IMSI catchers. A big part of our lives is recorded and exploited, from our web searches, to our personal communications, location, and our shopping habits, just to name a few data points, to generate even more data about us, through the observation of the data trail we leave behind.

Our lives are then not only under the scrutiny of governments and their (mass) surveillance activities, but also under the eyes of corporations looking to extract value from our data and interactions. All of this is happening at a global scale, and in many cases with little or non-existent safeguards.

The Privacy International Network is working to expose companies that fail to protect their customers’ data, analysing their terms of service and practices, exploring how users perceive social media platforms, and studying how these platforms are being leveraged for intelligence purposes.

Telecommunications: How do they (not) defend our data?

How transparent are telecommunication companies about their collaboration with law enforcement agencies? Red en Defensa de los Derechos Digitales (R3D) posed that question in their report “Who does not defend your data” (available in Spanish). It examines a new federal telecommunications law in Mexico that imposed obligations for telecommunications companies to collaborate with law enforcement agencies, many of them poorly drafted and undermining the right to privacy.

In Uganda, Unwanted Witness had a similar question. They researched the existing legal framework on telecommunications and privacy to explore how companies were protecting their customers’ data. Their subsequent report is pretty self-explanatory: Your Communication and Personal Data is not Safe Anymore, and highlights the lack of regulation to protect the rights of the users of telecom companies and Internet Service Providers, which is compounded by the absence of data protection legislation.

  <picture> </picture>

(In)visible followers: Social and state surveillance enabled by social media

Our relationship with social media is becoming increasingly complex: while providing new audiences to promote our messages and defend our causes, it also enables unprecedented levels of surveillance of our actions.

7iber focused their attention on that tension, investigating why people in Jordan are increasingly migrating from Facebook to Twitter (available in Arabic). Two members of the PI Network have studied this issue: Dejusticia, in Colombia, researched the accountability of Google and other big Internet companies, while Digital Rights Foundation (DRF) prepared a report about ride-sharing apps in Pakistan.

After analysing privacy policies from more than 30 companies with business models based on data exploitation, Dejusticia found that their practices were not properly addressed by the current personal data framework (available in Spanish). Moreover, they concluded that many of these practices, like user profiling, need to be further addressed by legislative and regulatory reform.

In Pakistan, DRF prepared a detailed study on the practices of Uber and Careem in the country, highlighting the need for better complaints mechanisms and security procedures, which are particularly necessary from a gender perspective and the specific impacts that such policies have over women. They also found that both companies’ privacy policies lack basic guarantees such as data breach disclosures and contain unspecified data sharing provisions, among other flaws.

Countering the hidden data ecosystem

Alongside the work of its partners, Privacy International has been active in countering corporate exploitation. This could include injecting ‘smart’ tech into delivering services, public safety, environmental monitoring, traffic control, among other possible applications.

One in particular aspect of smart cities has been consistently problematic: how these projects are used to boost law enforcement and policing under the guise of public safety. A report published by Privacy International last year featured case studies from Rio de Janeiro and Davao city, highlighting how these projects aren’t really improving public safety nor improving crime rates, but exacerbating inequalities and repressing public manifestations.

As a result of these projects, cities are transforming into monitored spaces, where an individual’s autonomy is steadily shrinking. The right to privacy in a connected city is also affected, since people are no longer expected to control how their data is collected, processed, and shared, but instead, are exposed to both government and corporate surveillance from the moment they leave their homes. In other words, smart cities are just a fancy name for turning urban centres into high-tech Panopticons.

The case of the Government of Punjab (Pakistan) goes a step further. The project isn’t even branded as a “smart city”, but “safe cities”. While the “smart city” name already involves indiscriminate surveillance and data collection, it still evokes a sense of opportunity to improve the life conditions of the inhabitants of a city through the use of technology.

According to the analysis of our partner in Pakistan, Digital Rights Foundation, the concept of “safety” behind the project is not necessarily aligned with most people’s expectations around safety, which involves public spaces being welcoming of everyone.

Instead, the “safe cities” project implies a further shift towards mass policing and surveillance. This raises even more questions and concerns around its impact on human rights such as privacy, freedom of movement, and non-discrimination, while exploiting people’s fears and concerns.

The idea that just by procuring more digital technologies for law enforcement purposes abuses of power will stop and safety will be improved, is flawed. Without more transparency, accountability, strong privacy policies, meaningful oversight, and limits to power, more technology will only deepen these systemic problems and reinforce current power imbalances.

In sum, the shift in branding “smart cities” as “safe cities” is a worrying development. Not because both concepts are too different in practice, given that often the difference lies only in the name. While comprehensive in some respects, the Personal Data Protection Bill has a number of significant shortcomings.

We recommend that to effectively protect privacy and meet internationally recognised data protection standards, full consideration must be given to the areas of concern and improvements presented below and developed in more detail in our submission under each Part of the Bill:

To include public bodies and government-held personal data: The scope of the law should not be restricted to commercial transactions;

Expanding the definition of “personal data”: As a central component of the law, the definition of personal data must be reviewed to encompass all personal data held by both private and public bodies without the caveat of “commercial transactions” attached to it;

Define the scope of the Act clearly: It is essential for the law to clearly define its material and territorial scope to ensure that the rights of data subjects are protected regardless of where their data is processed or held;

Definition of consent: Given that consent of the data subject is one of the major grounds for processing of personal data, it is important that consent be defined clearly in section two, and that the definition adopted ensures that consent must be explicit, free, informed, proactive and specific;

The definition of “sensitive personal data”: Biometric and genetic personal data must be included within the definition of sensitive personal data. This is particularly relevant in Pakistan where various biometric data-intensive systems have been deployed;

Safeguards against mass surveillance: Data processing by law enforcement agencies and investigative and intelligence bodies must be included within the scope of the law to ensure those activities are regulated. These authorities should be subject to data protection obligations as well as the standards of necessity and proportionality enshrined in international human rights law;

International data sharing: Data processing and sharing activities by Pakistani data controllers and foreign entities must be regulated by this Bill and higher standards should be in place to govern such transfers;

Limit broad powers given to the Federal Government to make exemptions: Exemptions to the Act should be limited and we recommend that the Bill be amended to limit broad discretionary powers awarded to the Federal Government, and to ensure that any deviations from the Act be subject to an open, inclusive and transparent legislative process.

We look forward to informing the next steps of the consultative process opened by the Pakistani Ministry of Information Technology and Telecommunications in the hope that the process will be inclusive, transparent and well-defined.

To find out more about our work in Even countries with data protection laws often lack effective implementation and enforcement or have not updated their legislation to address current uses (and abuses) of personal data.

Civil society organisations are needed to engage in these policy processes. Our experience has shown that when civil society is involved, the process is more inclusive, open and richer.

With this objective in mind, PI has developed a guide for civil society. This is a tool for analysing proposed data protection law and assessing existing legislation to identify any shortcomings.
